These Terms of Service ("Terms") govern your use of the services provided by Precision Kettlebells – Kettlebell Kuts, owned and operated by Mike Barbato and associated employees/contractors ("we," "our," "us"). By accessing or using our website, programs, coaching, text messaging, or related services, you agree to be bound by these Terms.

1. Services Provided

We provide kettlebell training programs, nutrition coaching, online resources, and related services. Services may include in-person and digital offerings, including communications by email and SMS/text message when you opt in, request information, or otherwise interact with us.

2. Eligibility (18+)

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this requirement.

3. SMS/Text Messaging Terms

Opt-In: If you provide your mobile number and opt in through our website or lead/booking forms (including Meta/Instagram lead ads), you consent to receive text messages from Precision Kettlebells. Our forms include consent language similar to: “I consent to receive marketing/promotional text messages from Precision Kettlebells. Message frequency may vary. To opt out reply STOP at any moment. Message and data rates may apply.”

Types of SMS Messages: If you opt in, text messages may include:

  • Conversational: responding to your inquiries and requests for information.
  • Customer Care: scheduling confirmations/reminders, updates you request, program onboarding, and service-related notices tied to your participation or request.
  • Marketing/Promotional: offers, program announcements, and limited-time promotions.
  • Consent Not Required to Purchase: Your consent to receive SMS messages is not a condition of purchase.
  • Message Frequency: Message frequency may vary based on your interactions and the services you request.
  • Message & Data Rates: Message and data rates may apply.
  • Opt-Out: Reply STOP at any time to cancel. You may receive one final confirmation message.
  • Help / Support: Reply HELP for assistance, or email info@precisionkettlebells.com.
  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

Mobile Information Sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with service providers solely to support services you request (such as SMS delivery platforms, CRM systems, scheduling/booking tools, and customer support).

4. Health Disclaimer

Our programs involve physical exercise. You acknowledge and agree that:

  • You should consult with a physician before beginning any fitness or nutrition program.
  • You participate voluntarily and at your own risk.
  • We are not responsible for any injuries, health issues, or medical conditions that may arise from participation.

5. Payments & Refunds

All program fees must be paid in full before participation unless otherwise arranged. Refunds are provided only as stated in specific program agreements, policies, or promotions. Payment details are processed securely by third-party providers; we do not store full credit card information.

6. User Conduct

You agree not to:

  • Use our services for any unlawful purpose.
  • Share, resell, or distribute our content or programs without permission.
  • Harass, abuse, or disrupt other participants, clients, or coaches.

7. Intellectual Property

All content provided through our programs, websites, and coaching (including text, videos, workouts, and materials) is owned by Precision Kettlebells unless otherwise noted. You may not reproduce, distribute, or create derivative works without written consent.

8. Termination

We reserve the right to suspend or terminate your access to our services at our discretion if you violate these Terms or engage in conduct harmful to our community.

9. Limitation of Liability

To the fullest extent permitted by law, Precision Kettlebells, Mike Barbato, and associated employees/contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
